A WOMAN spotted dropping a cigarette got slapped with two fines – one for the fag butt and one for the Fixed Penalty Notice that she then threw on the ground in disgust.

Eve Preston, of Sutton Way in Ellesmere Port, was caught in the act by a council enforcement officer on Frodsham Street, Chester, on March 1 this year.

He approached her and pointed out that dropping cigarette ends is classed as littering and began to process an on-the-spot fine, or FPN.

Ian Moore, prosecuting for Cheshire West and Chester Council at Chester Magistrates Court on Thursday (September 19), said: “The defendant refused to accept the FPN and walked away.

“The officer then placed the FPN in the hood of her jacket but she moved it from the hood and threw it on the floor saying ‘what the f***? That’s assault mate!’”

She then gave her name as Avril Brunton along with a different address, but council officers later recognised and identified her through the bodycam footage in August.

She was charged with two counts of littering, for both the cigarette butt and the spot-fine paperwork that she threw onto the street.

Preston failed to attend court and the case against her was proven in her absence.

She was fined £120 for littering and providing a false name and address and must also cough up £80 court costs and a £30 victim surcharge.

The total of £230 will be deducted from her benefits.
