A CHESTER night-time reveller who spat at a club doorman's face was told it was a "revolting" thing to do when he appeared at Chester Magistrates Court on Friday (January 4).

Samuel Moir, 28, of Pentland Close, pleaded guilty to assaulting Lance Gittens, the doorman at Rosies nightclub, as well as obstructing PC Michael Rowlands and possessing two small bags of cocaine.

All offences happened on the night of December 14, 2018.

District Judge Nicholas Sanders said: "Spitting at people is revolting; Mr Gittens is a doorman, someone carrying out public duty and does not need people like you turning up and doing that.

"If you can't behave appropriately in town you will be banned from there."

Moir was handed a community order with a 20-week curfew requirement.

Prosecuting, Eve Johnson said police had been called to an assault at Rosies nightclub that night, and outside the defendant was verbally aggressive and spat in the doorman's face, "causing shock and disgust".

Moir was obstructive and when taken to custody, a bag of white powder fell off him, which is found to be cocaine. Another was found following a police search.

In interview, Moir was said to be "7/10 drunk" and remembered being in Rosies but did not remember spitting at the security guard. He accepted his actions were unacceptable.

He had not been before the court since 2014.

In his defence, the court heard this type of behaviour was out of character for him. He was very drunk and had taken a substance.

The court heard Moir runs an event hire business and while a curfew would be acceptable, the hours would need to take into consideration when he turns up to venues to clean up after an event is held.

As a result, the 20-week curfew imposed on Moir has hours of 6pm-6am for the first 10 weeks and 8pm-6am for the second 10 weeks. During those hours Moir will be electronically monitored at his home address.

In addition, he was fined £100 and must pay £250 compensation to Lance Gittens, plus £85 court costs and an £85 victim surcharge.

The cocaine was to be forfeited and destroyed.
