NOTICE TO UNKNOWN OWNER(S) IN ADVANCE OF REQUESTING LANCASHIRE COUNTY COUNCIL TO ADOPT THE LAND SITUATED OFF UNITY WAY, HASLINGDEN OLD ROAD, RAWTENSTALL, FOLLOWING THE CARRYING OUT OF STREET WORKS PURSUANT TO SECTION 228 HIGHWAYS ACT 1980 BROTHER DEVELOPMENTS LIMITED (the "Developer") hereby give notice that in connection with the residential development of the Site edged blue on the attached Plan, it intends to carry out street works on the land situated off Unity Way, Haslingden Old Road, Rawtenstall shown coloured green ("the Green Land") on the Plan together with other land in the ownership and/or control of the Developer in order to make up the street to an adoptable standard. The Green Land is unregistered and a number of title investigations have been carried out but the Developer has been unable to identify any owner(s). On completion of the street works, it is the Developer's intention to request Lancashire County Council exercises its statutory notice procedure under Section 228 of the Highways Act 1980 ("the Act"). If no objection or challenge is raised, Lancashire County Council shall declare the Green Land an adopted highway, maintainable at the public expense for all classes of users; which for the avoidance of doubt includes mechanically propelled vehicles (Natural Environment & Rural Communities Act 2006).
